These Terms of Service (“Terms”) govern your use of the K-FLEX South Africa/Raidan Insulation website and the purchase of any insulation products or services from Raidan Insulation, the sole distributor of K-FLEX products in Southern-Africa
1. Acceptance of Terms
By accessing this website or placing an order for products, you agree to be bound by these Terms and all applicable South African laws and regulations. If you do not agree, you must cease use of the site immediately.
2. Scope of Service and Products
K-FLEX South Africa provides advanced elastomeric insulation systems.
- Technical Data: All product descriptions and technical specifications are subject to change without notice.
- Compliance: Products are intended to meet specific South African building standards, such as SANS 10400-XA.
3. Orders and Pricing
- Quotations: All quotes are valid for the period stated therein and are subject to stock availability.
- Payment: Terms for account holders are typically Net 30 days from statement, unless otherwise agreed in writing. Cash Sales require payment reflecting before stock can be handed over.
- Taxes: Prices are exclusive of VAT unless explicitly stated.
4. Delivery and Risk
- Shipping: K-FLEX South Africa provides nationwide supply across all provinces. Minimum delivery quantities apply for free shipping.
- Risk Transfer: Risk of loss or damage passes to the customer upon delivery to the specified site or collection by the customer’s carrier.
- Delays: While we aim for prompt delivery, we are not liable for delays caused by third-party logistics or factors beyond our control.
5. Returns and Quality Inspection
- Return Policy: Returns must be accompanied by a packing list. Products must be in resaleable condition; those deemed unsuitable will be returned at the customer’s expense or disposed of without reimbursement. Handling fees apply for goods correctly supplied.
- Documentation: Customers are encouraged to take photos of products before returning them to document condition.
6. Intellectual Property
All trademarks, logos (including the K-FLEX® mark), and content on kflex.co.za are the property of K-FLEX S.p.A. or Raidan Supply Zone cc. No license is granted for commercial use without express written consent.
7. Limitation of Liability
To the maximum extent permitted by law, K-FLEX South Africa [Raidan Insulation] shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products, including but not limited to loss of energy efficiency or system corrosion due to improper installation.
8. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of the courts in South Africa.
